Novedades legales en los contratos de alquiler que debes saber

Desde hace poco hay novedades legales en los contratos de alquiler que debes conocer.

Según informa la Generalitat de Catalunya y de acuerdo con el nuevo Real Decreto-ley 7/2019, de 1 de marzo de medidas urgentes en materia de vivienda y alquiler (BOE número 55, de 5 de marzo de 2019), los contratos de alquiler firmados a partir del 6 de marzo de 2019 presentan las siguientes principales novedades:


Si el arrendador (propietario/a) es una persona jurídica –es decir, una empresa, una entidad o una organización–, debe asumir los gastos de gestión inmobiliaria y de formalización del contrato.

Garantías adicionales a la fianza

Aparte de la fianza, que es de una mensualidad, se pueden pactar otras garantías adicionales tales como un aval bancario, un depósito, etc. En el caso de los contratos de hasta 5 años de duración –o de 7 años si el arrendador fuera persona jurídica–, el valor de la garantía adicional no puede exceder las 2 mensualidades de renta, excepto que se trate de un contrato de larga duración.

Duración y prórroga del contrato

La duración del contrato puede pactarse libremente, pero si es inferior a 5 años –o 7 años si el inquilino es una persona jurídica–, se prorrogará anualmente hasta llegar a un mínimo de 5 o 7 años, según corresponda, salvo que el inquilino comunique al arrendador con 30 días de antelación la voluntad de no renovarlo. Una vez transcurridos los 5 o 7 años de duración mínima, si ninguna de las partes notifica la voluntad de no renovar el contacto (el arrendador deberá comunicarlo con 4 meses de antelación y los inquilinos al menos 2 meses antes), se prorrogará por plazos anuales hasta un máximo de 3 años más. Sin embargo, el inquilino puede oponerse a estas renovaciones anuales, siempre que lo comunique con un mes de antelación.

Actualización de la renta

El precio del alquiler se renovará cada año y se aplicará la variación del IPC de los últimos 12 meses.

El propietario puede recuperar el inmueble antes de los 5 años

Si el arrendador es una persona física, en el momento de la celebración del contrato puede hacer constar, de manera expresa, la necesidad de disponer de la vivienda antes del transcurso de 5 años para vivir él o ella o determinados familiares. En este caso, pasado el primer año de duración del contrato, podría no prorrogarlo.

Me and my partner have been trying to buy a flat and secure a mortgage with our banks during which we have been in... touch with many agencies, but none of them being as professional as Immoaugusta. Ignasi, who showed us the flat at the beginning – which we decided to make an offer for – was always available, supported us throughout the process and handled the requests of our lawyer efficiently too. He even went out of his way and pushed for our mortgage request to be evaluated quicker and helped resolve a potential issue with another agency, which was much appreciated. Unfortunately, at the end we were not granted a mortgage and had to request the prepayment to be sent back to us, and again there were no delays and everything went smoothly. We could only recommend this agency for anyone who would like a reliable process, and it is especially nice that no disadvantage comes from not being a native Spanish speaker as we were helped in English (which is needless to say not available by default generally in Barcelona). If there was one thing I would recommend to potential buyers when applying for a mortgage is to make sure they are directly dealing with the banks too, as we had a not-so-pleasant experience when relying on Prohipotecas, a company that was recommended to us by Immoaugusta.
