Nuevos Cambios Fiscales en Cataluña: Subida del ITP y Nuevas Condiciones para Grandes Tenedores

Desde el 27 de junio de 2025, entra en vigor en Cataluña una importante reforma fiscal que afecta al Impuesto de Transmisiones Patrimoniales (ITP), con especial impacto en operaciones inmobiliarias de alto valor, grandes tenedores y compraventa de edificios residenciales completos.

1. Subida del ITP para inmuebles de más de 600.000 €

Se introduce una nueva tarifa progresiva que incrementa el gravamen según el valor del inmueble:

2. Tipo del 20% para grandes tenedores

Se aplica un tipo impositivo del 20% a transmisiones de inmuebles cuando el comprador es un gran tenedor (más de 10 inmuebles o más de 1.500 m² de uso residencial). También se aplica a la compra de edificios residenciales completos, incluso si el comprador no es un gran tenedor, salvo en casos excepcionales como fines sociales o entidades sin ánimo de lucro.

3. Cambios en el tipo reducido del 5%

  • Se amplía de 32 a 35 años la edad máxima para jóvenes que acceden al tipo reducido.
  • Se incluye a víctimas de violencia machista que adquieran su vivienda habitual.

Consecuencias en el mercado inmobiliario

Desde el sector ya alertan de un impacto negativo en la inversión inmobiliaria, con operaciones canceladas y menor incentivo para comprar, rehabilitar o alquilar viviendas. Abogados, consultoras y asociaciones coinciden en que la medida añade inseguridad jurídica y eleva la percepción de riesgo.

  • Marta Martín (AM2 Legal): “Se han cancelado operaciones importantes. Es una medida recaudatoria que ataca a quienes pueden poner vivienda en alquiler”.
  • Carolina Pérez (Colliers Barcelona): “La medida ha provocado retirada de inversores incluso antes de su entrada en vigor”.
  • CBRE: “Desincentiva la compra para rehabilitar y alquilar, lo que reduce aún más la oferta”.
  • Arantxa Goenaga (AF Legis): “No fomenta el alquiler ni incentiva la inversión, justo lo contrario”.

¿Qué pasará ahora?

Se está tramitando un proyecto de ley en el Parlamento de Cataluña para aclarar y corregir puntos ambiguos de la norma, como la definición de “gran tenedor”, que actualmente tiene hasta tres interpretaciones distintas según el contexto legal.

Desde la Asociación de Propietarios de Viviendas en Alquiler (Asval) valoran positivamente que se abra la puerta a una revisión que permita alinear la ley con su objetivo: fomentar el alquiler.

Me and my partner have been trying to buy a flat and secure a mortgage with our banks during which we have been in touch with many agencies, but none of them being as professional as Immoaugusta.

Ignasi, who showed us the flat at the beginning – which we decided to make an offer for – was always available, supported us throughout the process and handled the requests of our lawyer efficiently too. He even went out of his way and pushed for our mortgage request to be evaluated quicker and helped resolve a potential issue with another agency, which was much appreciated. Unfortunately, at the end we were not granted a mortgage and had to request the prepayment to be sent back to us, and again there were no delays and everything went smoothly.

We could only recommend this agency for anyone who would like a reliable process, and it is especially nice that no disadvantage comes from not being a native Spanish speaker as we were helped in English (which is needless to say not available by default generally in Barcelona). If there was one thing I would recommend to potential buyers when applying for a mortgage is to make sure they are directly dealing with the banks too, as we had a not-so-pleasant experience when relying on Prohipotecas, a company that was recommended to us by Immoaugusta. Overall though, we would be happy to become customers again as the experience was 10/10

My partner and I relocated from the UK to Barcelona and found ourselves really struggling as we didn’t speak any Spanish.

We tried a few other estate agencies who weren’t helpful, didn’t care that we couldn’t speak English and couldn’t help arrange viewings on the then limited dates we had to travel to Barcelona.

Ultimately they helped us find our dream home but not only that but supported us settling into the city with help on local knowledge. Nothing was too much even meeting us at 10pm with the keys when we landed here in Barcelona on a late flight.
