Gestionar una herencia es un proceso que, además de implicar una fuerte carga emocional, requiere cumplir con pasos legales y fiscales muy concretos. Un error en la tramitación de herencias puede generar problemas, retrasos y costes innecesarios, sobre todo cuando se trata de herencias inmobiliarias, donde se necesita una valoración profesional del inmueble para reflejarla en la aceptación.

A continuación, repasamos los 7 errores más comunes en herencias y cómo evitarlos, según el abogado experto Manuel Vilches.

1. No liquidar correctamente ni a tiempo el impuesto de sucesiones
El incumplimiento de plazos o errores en la base imponible generan recargos, intereses y sanciones. El plazo general es de seis meses desde el fallecimiento, prorrogables en ciertos casos.

2. Realizar actos de aceptación tácita de la herencia
Cobrar rentas, vender bienes o disponer de activos del causante implica aceptar la herencia sin reservas, lo que puede ser un problema si después aparecen deudas desconocidas.

3. Solicitar fuera de plazo la aceptación a beneficio de inventario
Esta opción permite responder a las deudas del fallecido solo con los bienes heredados, pero muchos la solicitan tarde y se ven obligados a aceptar la herencia pura y simple.

4. No pedir los certificados de seguros de vida
Las aseguradoras están obligadas a informar a la Administración, pero los herederos deben solicitar los certificados para no perder posibles derechos económicos.

5. Valorar los inmuebles por debajo del precio de mercado
Si se planea vender la vivienda heredada, conviene declararla a precio real de mercado en la aceptación. De lo contrario, al vender se generará una ganancia patrimonial y habrá que pagar más en la Renta.

6. No revisar los movimientos bancarios del fallecido
Es clave consultar las cuentas para detectar ingresos pendientes, cobros indebidos o pagos automáticos que convenga cancelar.

7. Olvidar computar gastos deducibles
Gastos de entierro o de la última enfermedad deben incluirse en la herencia, ya que reducen la carga fiscal y evitan conflictos.

Me and my partner have been trying to buy a flat and secure a mortgage with our banks during which we have been in touch with many agencies, but none of them being as professional as Immoaugusta.

Ignasi, who showed us the flat at the beginning – which we decided to make an offer for – was always available, supported us throughout the process and handled the requests of our lawyer efficiently too. He even went out of his way and pushed for our mortgage request to be evaluated quicker and helped resolve a potential issue with another agency, which was much appreciated. Unfortunately, at the end we were not granted a mortgage and had to request the prepayment to be sent back to us, and again there were no delays and everything went smoothly.

We could only recommend this agency for anyone who would like a reliable process, and it is especially nice that no disadvantage comes from not being a native Spanish speaker as we were helped in English (which is needless to say not available by default generally in Barcelona). If there was one thing I would recommend to potential buyers when applying for a mortgage is to make sure they are directly dealing with the banks too, as we had a not-so-pleasant experience when relying on Prohipotecas, a company that was recommended to us by Immoaugusta. Overall though, we would be happy to become customers again as the experience was 10/10

My partner and I relocated from the UK to Barcelona and found ourselves really struggling as we didn’t speak any Spanish.

We tried a few other estate agencies who weren’t helpful, didn’t care that we couldn’t speak English and couldn’t help arrange viewings on the then limited dates we had to travel to Barcelona.
